| Part VII - Penalties and Appeals |
|
7.1 Any breach of these rules and regulations and The University of Western Australia Lands By-Laws and Statute seventeen insofar as these By-Laws apply to the College makes the resident so doing liable to the following range of penalties:- (a) Censure. (b) Fines up to the equivalent of the maximum fortnightly living allowance payable to an independent under the provisions offered by the Commonwealth undergraduate student support scheme. (c) Suspension of privilege. (d) Suspension of the right of residence for a period not exceeding one semester. (e) Termination of residence. (f) The penalties prescribed in rule 3.6 of this By-Law. 7.2 The Warden shall be, except as may be otherwise provided for in these rules and regulations, the sole judge of whether a person has breached the rules and regulations of the College and of the penalty (if any) to be applied. 7.3 The Warden may at his discretion refer the determination of whether or not a resident has breached the rules and regulations of the College to another person or persons and the Warden may also seek from that person or persons a recommendation as to the penalty to be imposed. 7.4 Where a member has caused the loss of or damage to property whether of the College or of another member of the College the Warden shall have the power to order the offending member to make restitution in whole or in part or to request some other person or persons to recommend to the Warden whether restitution should be made and whether in whole or in part. Nothing in this provision shall be construed so as to prevent the College or a member thereof who has sustained loss of or damage to the College's or that member's property exercising any right of recovery or restitution that may be had at law. 7.5 Restitution for loss or damage is not a penalty. 7.6 Where there is loss of or damage to College property and the person causing the loss or damage cannot be identified, the St George's College Club shall unless otherwise determined by the Warden, be required to make restitution for the said loss or damage but the said Club shall not in any case be liable to a penalty. 7.7 (ii) The Chairperson or his/her nominee may appoint three assessors who shall be members of the College Council other than ex officio members to advise him/her on the matter. (iii) The Warden may be neither the nominee of the Chairperson nor an assessor. (b) Notice of appeal must be given in writing to the Secretary of the College Council with particulars of grounds of appeal within seven days of the Warden issuing written notice of termination of membership of the College. (c) When an appeal has been lodged the Secretary of the College Council shall inform all members of the College Council by circulating to them copies of all documents lodged by the appellant relating to the appeal. (d) The decision of the Chairperson or his/her nominee in the matter of an appeal is final. |
